Welcome to MindEdge! These Terms of Service ("Terms") govern your use of the MindEdge mobile application (the "App") provided by MindEdge ("we," "our," or "us").
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Acceptance of Terms
By creating an account or using MindEdge, you confirm that:
- You are at least 13 years of age
- You have read, understood, and agree to these Terms
- You have read and agree to our Privacy Policy
- You understand and accept our Disclaimer regarding mental health
2. Description of Service
MindEdge is a mental performance coaching application designed to help athletes and individuals develop mental skills for peak performance. The App provides:
- AI-powered coaching conversations
- Mental performance strategies and techniques
- Mood and energy tracking
- Progress insights and analytics
- Personalized recommendations

MindEdge is NOT a substitute for professional mental health treatment, therapy, medical advice, diagnosis, or treatment.
The App is designed for:
- Educational purposes
- Personal development
- Performance enhancement
- Self-improvement
3.1 When to Seek Professional Help
If you are experiencing:
- Depression, anxiety, or other mental health conditions
- Thoughts of self-harm or suicide
- Severe emotional distress
- Any psychological crisis

By using MindEdge, you acknowledge that:
- Content is for informational and educational purposes only
- You are responsible for your own mental health decisions
- Results may vary and are not guaranteed
- The App does not provide professional psychological services
4. Account Registration
4.1 Account Creation
To use certain features, you must create an account by providing accurate and complete information. You may register using:
- Email and password
- Sign in with Apple
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4.3 Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms, provide false information, engage in abusive behavior, or attempt to circumvent security measures.
5. Subscription and Payments
5.1 Free and Premium Features
MindEdge offers both free features and premium subscription options ("MindEdge Pro").
5.2 Subscription Terms
- Subscriptions are billed in advance on a recurring basis (monthly or annually)
- Payment is processed through the Apple App Store
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- You can manage and cancel subscriptions in your App Store account settings
5.3 Refunds
Refund requests are handled by the Apple App Store according to their refund policies. We do not directly process refunds.
6. User Content
6.1 Your Content
You retain ownership of content you create in the App, including mood logs, notes, reflections, and chat messages.
6.2 License to Use
By submitting content, you grant us a limited license to store, process, and display your content solely to provide the Service.
6.3 Prohibited Content
You agree not to submit content that is illegal, harmful, offensive, infringes on intellectual property rights, contains malware, or impersonates others.
7. Intellectual Property
7.1 Our Content
MindEdge and its contents, including text, graphics, logos, strategies, exercises, coaching content, software, and user interface design, are owned by MindEdge and protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
7.3 Restrictions
You may not copy, modify, distribute, reverse engineer, or use the App for commercial purposes without authorization.
8. AI Coaching Feature
8.1 Nature of AI
The AI coaching feature uses artificial intelligence to provide responses. AI-generated content:
- Is not a substitute for human professional advice
- May occasionally produce inaccurate or inappropriate responses
- Should be used as one of many tools for self-improvement
8.2 Data Processing
Conversations with the AI coach may be processed by third-party AI services (such as OpenAI) to generate responses. This processing is subject to our Privacy Policy.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF CONTENT.
We do not warrant that the App will be uninterrupted, error-free, or completely secure.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDEDGE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or goodwill
- Any damages exceeding the amount you paid for the Service in the past 12 months
This limitation applies regardless of the legal theory and even if we have been advised of the possibility of such damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless MindEdge and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or violation of any third-party rights.
12. Modifications to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or sending a notification to your registered email. Your continued use of the App after changes constitute acceptance of the modified Terms.
13. Termination
13.1 By You
You may stop using the App and delete your account at any time through Settings → Delete Account.
13.2 By Us
We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms.
13.3 Effect of Termination
Upon termination, your license to use the App terminates, your data may be deleted, and provisions that should survive termination will remain in effect.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
15. Dispute Resolution
15.1 Informal Resolution
Before filing any formal claim, you agree to contact us at legal@mindedge.app and attempt to resolve the dispute informally for at least 30 days.
15.2 Arbitration
Any dispute not resolved informally shall be resolved by binding arbitration in accordance with the American Arbitration Association's rules.
15.3 Class Action Waiver
You agree to resolve disputes with us on an individual basis. You waive any right to participate in class action lawsuits or class-wide arbitration.
16. General Provisions
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and MindEdge regarding the App.
